Two planning applications for a total of 73 houses have been submitted for sites at the back and the side of Dunsoughly estate.

The application Ref. numbers for the two applications are FW17A/0066 and FW17A/0067.

If you wish to make an objection or observation on one or both of these applications, your objection must contain your name, address and the planning application Ref. number. An objection should be sent to the Planning Department, Fingal County Council, County Hall, Main Street Swords, Co. Dublin. You can also register online and make your objection/observation through the Fingal website here.

There is a €20 fee to make an objection. As there are two planning applications here, if you want to object to them both, you have to submit two separate objection letters (and two separate €20 fees).

The deadline for objections is the 29th May.

I organised for the two planning application be discussed at the Fingal Local Area Committee on the 4th May. Myself and the other councillors put questions to the Planners about the application. Good news: Bus Rapid Transit for Blanchardstown is back on the agenda

I am pleased to say that the National Transport Authority has confirmed that it plans to proceed with the Bus Rapid Transit (BRT) route between Blanchardstown and UCD in 2018. The confirmation came from Hugh Creegan, Director of Transport Investment for the National Transport Authority (NTA), at a meeting of the Fingal County Council – Dublin City Council Inter-Authority Forum which I attended last week.

The Bus Rapid Transit (BRT) will provide a high quality public transport route between the Blanchardstown Town Centre and UCD, via the City Centre. I have continually pointed out the size of the population growth in Dublin 15 – we have four of the ten fastest growing areas in the entire country. There must be new public transport put in place so the new and existing residents of Dublin 15 can go about their daily commute.

Hugh Creegan from the NTA stated that a design team had been appointed for the Blanchardstown-UCD BRT route and that a public consultation phase would start later in 2017, with a view to having a planning application for the route submitted in 2018. Significantly, he also stated that NTA felt that they have the necessary funding for the project. This is important, as when the last government announced the Capital Investment Programme 2016-21, no funding for the BRT was provided at that time.

With more houses being built across Dublin 15 in Tyrrelstown, Hansfield and Carpenterstown, it is good that the National Transport Authority is finally providing for the needs of our area. I look forward to engaging in the public consultation process, so we can ensure that we get the very best route and range of stops for commuters and communities across West Dublin.

Protective Services Unit will be in operation in Dublin 15 by middle of the year

I’m delighted that the Gardai have confirmed that a Protective Services Unit is to be located in the DMR West region by the middle of this year. This was confirmed to me in response to a question I had put down at last weeks meeting of the Fingal Joint Policing Committee.

Nationally, the Protective Services Bureau deals with a range of specialist crimes including sexual and domestic violence, the management of sex offenders prosecuting organised prostitution and investigating missing persons. It is an important development that Dublin 15 will now have a unit specialising in dealing with these crimes, located in the area.

I’m delighted to see that Dublin Bus has announced a new early morning 38B service. The bus will leave Damastown at 6:00am.

Since September, I have been in regular contact with Dublin Bus to improve capacity on this route, due to the increased number of commuters who are using it. Prior to Christmas, Dublin Bus agreed that more tri-axel buses would be used on the 38B route, as these have a 30% greater passenger capacity.

These improvements are very welcome for residents of Mulhuddart, Corduff and Waterville, all of whom are served by the 38B. The new service will start operating from Monday 20th February.

I will also continue to lobby Dublin Bus to look at providing a bus service through the Waterville estate. There are over 1,500 apartments and houses in this area and a direct route through it would be hugely beneficial to the residents.

Big changes to Snugborough Road bridge and junction proposed

Fingal County Council are bringing forward a proposal for a major change to the Snugborough Road bridge and junction. This proposal is currently out for public consultation. The key details are:

  • Upgrading the existing five-arm signalised junction at Snugborough Rd/N3 off-ramp/Blanchardstown Centre. Widen all road approaches, provide new high quality pedestrian/cyclist facilities and new public transport priority measures.
  • Removal of right hand turning movement from Waterville onto the Snugborough Road.
  • Removal of existing roundabout at Snugborough Rd/N3 on-ramp/Waterville and construction of 2 new signalised junctions in its place.
  • Construction of new bridge structures over the N3 and over the Tolka Valley.
  • Replace existing ramp access to Tolka Valley Park with access at similar grade.

Disappointed by decision to grant planning for apartment block at Brady’s Pub

I’m deeply disappointed to see that Fingal has granted planning permission for for 38 two and three bedroom apartments on the Brady’s Pub site on the Old Navan Road. While we all understand that there is a need for more houses to be built, this does not mean that the Council should permit types of development that are clearly not suited to the area they are being proposed for.

What is proposed for the Brady’s Pub site is a four storey apartment building which will tower over the existing two storey houses that are immediately beside it. The shadow analysis provided by the developers proves that there will be a significant impact on existing homes when these four storey building are put into such a small site. People are going to lose sunlight and privacy.

While the Council has made a small reduction in the number of permitted apartments to 38 from the original 41 that were requested, the development still is not suitable. A traditional housing development would be both more appropriate on this site, and also help meet the demands for family homes in Blanchardstown.

I’ll keep working with affected residents in relation to appealing this decision to An Bord Pleanala.

Government must suspend all home repossession proceedings to clarify if they are fulfilling EU law obligations

Today I joined the Green Party TDs and Senator to call Government to immediately introduce a moratorium on home repossessions, as there is a risk that EU Law is not properly being applied in the repossession process and the State may be liable for illegal repossessions if EU law if this is the case.

On the 21st of December, the High Court ruled in the case of AIB v Counihan that European Consumer Law must be considered in the context of home repossessions. This means that Judges or County Registrars dealing with repossessions must carry out an assessment of whether the contract’s terms were fair and proportionate. Further to this, EU case law in Kušionová may also require such assessments be made with reference to the fundamental protection afforded to the ‘home’ under the European Charter of Fundamental Rights. Failure to abide by EU law, where applicable, would render repossessions illegal – with the State liable.

This is a very serious situation. Prior to Christmas the County Waterford Registrar suspended all repossession cases until there is legal clarity – but all other areas are continuing as before. The Government must consult the Judiciary and County Registrars to ensure that the resources required to carry out the assessments, as laid down by EU law, are available. If cases continue to be processed without the necessary resources being allocated, the State is likely to be liable if repossessions occur for failing to afford consumers the protections they are entitled to.

We’re calling for the Government to introduce a moratorium on repossessions until they have consulted the Judiciary and County Registrars to ensure that there are adequate resources to fulfil the legal obligations under EU law, and legal clarity is restored. The Minister for Justice has agreed to debate the matter in the Dail this evening.

A significant new planning application has been submitted for the site at the corner of the Clonsilla Road and Clonsilla Link Road, beside Porters Gate estate.

The proposed development is for:

  • 103 residential units in total (made up of 67 two storey houses and 36 apartments in two 3 storey blocks)
  • A two storey convenience food store of 1,300m2 aprox
  • A single storey building with a cafe and shop
  • 40 carparking spaces for the aparetment blocks and 82 spaces for the commercial development
  • An ESB substation
  • New entrance off the Clonsilla Link Road (opposite entrance to Castlefield Court)

There is already planning permission in existence (which applies up to 2020) for 166 residential units (138 apartments and 28 houses) and some commercial units on this site.

The applicant number is FW16a/0176. The deadline for submission is the 13th Jan.
